Synopsis:

To criticize the English crown or its representatives in the 18th century was

a crime of treason. John Peter Zenger printed articles concerning a new governor’s

dispute with the New York Supreme Court in his newspaper and was brought to trial

for seditious libel He was defended by the original Philadelphia lawyer,

Alexander Hamilton. Hamilton successfully argued for freedom of the press,

suggesting that American enjoyed greater freedom than citizens of Great Britain,

including the right to print truthful criticism of the government. Although the jurors were

instructed by a judge (appointed by the governor) that they were only to consider

whether Zenger printed the articles, not their veracity, Hamilton had already argued

that they were free to ignore the instructions and render the verdict according to their

own consciences. This was the first case in which truth was asserted as a defense in

a libel suit as well as one of the first instances of jury nullification in the U.S. [RF]
